Terms of Service

These Terms govern your use of Ask Scout (“Scout,” “we,” “us”), operated by The Customer Lab, based in Sydney, NSW, Australia. By creating an account or installing the Ask Scout Shopify app, you agree to these Terms. If you're agreeing on behalf of an agency or company, you represent that you have authority to bind that organization.
1. What Scout does
Scout reads data from connected platforms (Shopify, Klaviyo, Meta, Google) on your behalf and uses it to draft weekly client reports. Scout is read-only - we never write to, modify, or post on your connected accounts.
2. Accounts
You're responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access. One account per individual - no sharing credentials.
3. Acceptable use
You agree not to:
- Use Scout for any unlawful, fraudulent, or abusive purpose
- Connect stores you don't have permission to access
- Reverse engineer, scrape, or attempt to bypass rate limits
- Use Scout's output to impersonate another business or person
- Resell, white-label, or sublicense Scout without written permission
4. Your content
You retain ownership of any content you add to Scout (notes, voice profiles, edited reports). You grant us a limited license to store, process, and display that content solely to operate the service. We may use anonymized, aggregated usage data to improve Scout.
5. Merchant data
Data Scout accesses from connected platforms remains the property of the merchant or the agency that controls the relevant account. Scout acts as a processor. See our Privacy Policy for details on what we collect, how we use it, and retention periods.
6. AI-generated drafts
Reports drafted by Scout are produced with the help of large language models (Anthropic's Claude). Drafts may contain errors, omissions, or inaccurate interpretations of data. You are responsible for reviewing and editing every draft before sending it to a client. Scout is a drafting tool, not a substitute for your professional judgment.
7. Fees
Scout is currently free during beta. When we introduce paid plans, we'll give existing users at least 30 days' notice before any charge. Paid plans, when introduced, are billed in advance and non-refundable except where required by law.
8. Third-party services
Scout connects to Shopify, Klaviyo, Meta, Google, and Anthropic. Each has its own terms and availability. We're not responsible for outages, changes, or behavior of those services.
9. Termination
You can cancel anytime by deleting your Scout account or uninstalling the Shopify app. We may suspend or terminate accounts that violate these Terms. On termination we delete your data per our Privacy Policy retention rules.
10. Disclaimers
Scout is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that Scout will be uninterrupted, error-free, or that drafts will be accurate.
11. Limitation of liability
To the fullest extent permitted by law, and subject to any non-excludable rights under the Australian Consumer Law, The Customer Lab's total liability arising from or related to Scout is limited to the amount you paid us in the twelve months preceding the claim, or AUD $150, whichever is greater. We're not liable for indirect, incidental, special, consequential, or punitive damages.
12. Changes to these Terms
We may update these Terms. Material changes will be announced via email or in-app notice at least 14 days before taking effect. Continued use after the effective date means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, excluding its conflict-of-laws rules. You and The Customer Lab submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising from or related to these Terms or Scout. Nothing in these Terms excludes any non-excludable rights you have under the Australian Consumer Law.
